Stephen Forsburg Motion (Amended)

Proposed Wheelmen position on the regulation, registration and/or licensure of e-bikes

1.  The Sacramento Wheelmen support a statewide definition of ebike that would:

a.     Limit the term “e-bike” to mean a 100% pedal assist electronic bicycle, i.e., an electronically motorized bicycle whereby the motor is engaged solely by the operation of the pedals.

b.     Clarify that Class 1 and Class 3 e-bikes shall be regulated as bicycles and shall only be subjected to the same statutory, regulatory and public education requirements as non-motorized bicycles.

c.      Class 1 and Class 3 e-bikes shall, under no circumstances, be subjected to license plate, registration, and/or insurance mandates, other than what may be already required of non-motorized bicycles.

2.     The Wheelmen board is hereby authorized to engage like-minded bicycle organizations and state and local legislative and regulatory bodies on the subject of ebike legislation and regulation and to take positions consistent with provision 1 above.

3.   That the Wheelmen by-laws be amended to add a new Section 9, entitled “E-Bike Restrictions, as follows:

      9.  E-Bike Restrictions

E-bikes that are not 100% pedal assist, including Class 2 e-bikes, “e-motos” and e-motorcycles, are prohibited from participating in Wheelmen events, including club sponsored rides, zodiacs and/or tours. On a case-by-case basis, the board may waive this prohibition as it pertains to Class 2 e-bikes if the board determines that a club member has unique circumstances that justify such a waiver.
